TERMS & CONDITIONS

1. Contract Policy

Please read carefully the reservation conditions and the information contained in the release forms that will be provided, as they will form the basis of your contract with C-Jay Watersports. The contract outlines the responsibilities and liabilities of both parties: C-Jay Water sports and you, the Signee. Any refusal to sign this form or adhere to the conditions stipulated will result in immediate termination of reservation.

2. Payment Policy

Full payment must be made to secure reservation. Online payments must be accompanied with a receipt. No part-payments or deposits will be accepted except for fishing activities ($200 non-refundable deposit).

3. Reservation Policy

Please make all reservations online or at the office identified on this website. Please note that no departure will take place before and after the hours of 9 am to 5 pm respectively, unless special arrangements were made prior to the date reserved. Moreover, all trips will leave the dock promptly at the time specified. We reserve the right to prohibit departure if the following documents cannot be provided: receipt of reservation made, ID (Passport/VISA/Driver’s license). Payments made by credit card must be done with proper identification. For questions regarding your reservations and changes to your reservation, please call the contact numbers provided below.

4. Weather Policy

We (C-Jay Watersports) reserve the right to cancel or reschedule any trip if we deem the weather to be unsuitable for activities. We will however, try our utmost best to find a suitable time or date to accommodate you before your departure. You will also have the option in such an event, to receive a voucher to be used on your future trip, if you are departing. In the event of bad weather occurring, during the time the activity is taking place, the trip or activity will be cancelled and rescheduled. Refusal (namely, Jet-sking) to cease from activity will result in penalties.

5. Rental Policy

Renters of Jet-Skis must: i. Be over the age of 18- children who are 16 and 17 years old must get permission from parents through a signed waiver.
ii. All children, below the age of 16 years old must be accompanied by a parent or an instructor, with written consent from the parent.
iii. Proof of ID must be provided (valid driver’s license, Passport, etc.)
Please note well, that intoxicated persons or those on sleep induced medications will not be allowed to operate Jet-skis.

6. Water sport Cancellations and Refunds

• Arrivals after the allotted time of the reservation or after 5 o’clock will be cancelled if not rescheduled through direct communication with the company (C-Jay Watersports). This cancellation is without refund.
• Late shows for reserved time may be allowed an alternative reservation on the same day if spaces are available.
• We reserve the right to cancel your reservation upon violation of policy.
• Factors may lead to cancellations includes: weather, violation of policy, problems with vessel, among others. Cancellations made on the part of the company will receive full refund. A 30% or more deduction will be made if the activity had already commenced.
• Cancellations done 48 - 24 hours before reserved date of activity will result in a 50% refund of full payment made for same activity(s).
• Cancellations made for fishing trip before the activity is commenced will result in refund minus the $200 deposit paid prior the activity.
• NO SHOWS will receive no refund
• No early-return refunds will be given
• Refunds will be made electronically to your credit card

7. Damages

• We reserve the right to charge you for any damages to equipment, including boat, jet-ski, dive tanks. Charges will be per equipment (This may be more or less based on actual damages)
• Damage or sinking of jet-ski due to stunts, racing, among other unsafe activities will result in full payment for repairs or a new jet ski
• Incompliance to instructor will result in immediate termination of trip or activity with no refund
• No part payments, full payments must be made for damages

8. Insurance

C-Jay Watersports carries liability insurance coverage for all equipment and boats, however physical damages incurred by third party during, before or after activity is NOT covered and not the liability of C-Jay Watersports. The third-party (the signee) is fully responsible for all of the costs related to damage of the equipment including lost assets. Disclaimer must be signed and liability and responsibilities adhered to.

9. Dive Policies

• All participant or signees for diving activities MUST sign a PADI form
• Health conditions must be disclosed, unless with a written permission from your doctor. The written permission must be given to the diving instructor prior to the trip. The onus of partial or no disclosure of medical condition that results in death or health issues is strictly the liability of the signee or the leader of the group of signees.

10. Company alterations

• We reserve the right to make alterations in boats or equipment in the event of unavailability or inadequate amount of our own, i.e, renting or borrowing boats/equipments from nearby Watersports companies.
• We reserve the right to make price alterations at anytime deemed necessary. However reservations made before the said alteration, will not be affected.

11. Personal Items (Not liable

We will not be liable for the damage or loss of any personal items taken on the trip. That will be at your own risk. “If you love it, don’t take it.”

12. Child Protection Policy

The burden of your child’s security rests on you. We will not be responsible for the death, injury or loss of any child during any activity.

13. Waiver

All signees must read properly the waiver for activities before signing. Misinterpretation that results in violation of the rules and responsibilities listed will not be the onus of the signee.
